AGREEMENT TO TERMS

By accessing or using The Creative Build workspace, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the service.

The Creative Build workspace is operated by Borengasser Partners LLC DBA The Creative Build, 3390 Peachtree Road NE, Suite 320, Atlanta, GA 30326, United States.

THE SERVICE

The Creative Build is a digital workspace for independent artists and creative entrepreneurs. It provides tools, educational content, and features designed to help you build a business around your creative work. Access is provided on a lifetime basis following a one-time purchase.

YOUR ACCOUNT

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at contact@thecreativebuild.com if you suspect unauthorized access to your account. You are responsible for all activity that occurs under your account.

You may not share your account with others. Access is granted to one individual per purchase.

ACCEPTABLE USE

You agree to use The Creative Build only for lawful purposes and in accordance with these Terms. You agree not to use the service in any way that violates applicable laws or regulations, attempt to gain unauthorized access to any part of the service or its related systems, or reverse engineer, copy, or reproduce any part of the service.

CONTENT YOU CREATE

The content you enter in your workspace, including your tool responses, planning items, and business information, remains yours. We do not claim ownership of your content. By using the service, you grant us a limited license to store and process your content solely for the purpose of providing the service to you.

INTELLECTUAL PROPERTY

The Creative Build, including its design, educational content, tool framework, and methods, is the intellectual property of Borengasser Partners LLC. You may not copy, reproduce, distribute, or create derivative works from any part of The Creative Build without our written permission.

PAYMENT AND ACCESS

All payments are processed by Paddle.com Market Limited, our merchant of record. By completing your purchase, you agree to Paddle's terms of service and privacy policy in addition to these Terms. Your purchase grants you lifetime access to The Creative Build workspace, including bug fixes and improvements we make to existing features. New features, tools, or content modules introduced after your purchase may be included at our discretion or offered separately.

DISCLAIMERS

The Creative Build is provided as is without warranty of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that it will meet your specific expectations. The educational content, tools, and frameworks provided are based on general business principles and do not guarantee any particular business outcome.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Borengasser Partners LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of The Creative Build, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from your use of the service shall not exceed the amount you paid for access.

GOVERNING LAW

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of The Creative Build shall be resolved in the courts of Fulton County, Georgia.

CHANGES TO THESE TERMS

We reserve the right to update these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of The Creative Build after changes become effective constitutes your acceptance of the updated Terms.
